Gun Trusts
A firearms trust (sometimes called a “gun trust” or “NFA trust”) is one of two methods of legally acquiring National Firearms Act (NFA) governed items such as suppressors, fully automatic guns, short barreled rifles and shotguns as well as “Any Other Weapon” (AOW) items. Although it is possible to register an NFA item to an individual, this approach can require more work and affords much less flexibility and security in possessing NFA items.
More and more Floridians are buying suppressors due in large part to the fact they can now be used in hunting on a wider scale. This prudent move by the Florida Department of Fish and Game now allows hunters to enjoy their sport without risking hearing loss and disruption to their fellow hunters and surrounding wildlife.
A properly constructed NFA trust does more than simply smooth out the process acquiring NFA items. It helps citizens sidestep stubborn chief law enforcement officers while providing security to an owner’s family and property as well as preparing for virtually every contingency.
Today gun trusts are being sold by a number of different parties including many that are not attorneys who have no formal legal training. Because unlawful possession of NFA items can be a federal crime that can be punished by time in federal prison, an NFA trust is an extremely important document and should be taken seriously. NOTE: As of now, the approximate wait time for processing of your ATF forms is 4-6 months. Further, although there are no guarantees, the ATF has announced that it intends to make the use of NFA trusts much more difficult and at this point it would seem that if you intend to use an NFA trust, the clock is winding down.
Relief from Firearms Disability
The Second Amendment to the United States Constitution states that “A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed”. This amendment put into writing the well accepted and ancient right to self defense from a variety of threats.
In recent years the US Supreme Court has made significant rulings that have helped buy cheap metformin re-enforce this principle as an individual right and has helped tear down laws put in place by state, county and city restrictions on the individual right to keep and enjoy firearms.
Thankfully, Florida is among the states that have chosen to preserve individual liberty as it pertains to guns. However, the landscape of firearms law can still be difficult to navigate for the average Floridian due to the overlapping patchwork of federal and state gun laws.
